Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the services provided by Nilum Tech AB (org. nr 559552-5907), with its registered address at Tulegatan 28, 113 53 Stockholm, Sweden ("Nilum", "we", "us", or "our").

Nilum operates a digital platform (the "Service") that aggregates second-hand product listings from various online marketplaces and presents them to users. The Service is available through our mobile and web applications.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

• "User" or "you" refers to any individual who accesses or uses the Service.
• "Service" refers to Nilum's digital platform, including all mobile and web applications, through which aggregated second-hand product listings are displayed.
• "Listings" refers to the product listings sourced from third-party marketplaces and displayed within the Service.
• "Third-Party Platforms" refers to the external online marketplaces from which Nilum aggregates Listings.

3.1 Description

Nilum is a second-hand marketplace aggregator. We collect and present product listings from various Third-Party Platforms in our application, allowing you to discover and browse listings across multiple sources. When you click on a Listing, you are redirected to the Third-Party Platform where the listing is hosted.

3.2 No Sales by Nilum

Nilum does not sell, purchase, or facilitate the sale of any products. We do not act as a party to any transaction between you and a Third-Party Platform or seller. Any purchase you make is governed by the terms and conditions of the relevant Third-Party Platform.

3.3 Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

4.1 Eligibility

You must be at least 16 years old to create an account and use the Service. By registering, you confirm that you meet this age requirement.

4.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@nilum.ai if you suspect any unauthorised use of your account.

4.3 Account Deletion

You may delete your account at any time from the Settings page in the Nilum app, or by emailing support@nilum.ai. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

When using the Service, you agree not to:

• Violate any applicable laws or regulations
• Use the Service for any fraudulent or unlawful purpose
• Attempt to gain unauthorised access to any part of the Service or its underlying systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated tools (bots, scrapers, etc.) to access the Service without our prior written consent
• Misrepresent your identity or affiliation

We reserve the right to suspend or terminate your account if you breach these Terms.

6.1 Nilum's Content

The Service, including its design, layout, software, text, graphics, and logos, is owned by or licensed to Nilum and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

6.2 Third-Party Content

The Listings displayed in the Service originate from Third-Party Platforms. Nilum does not claim ownership of this content. All trademarks, product names, and images associated with Listings belong to their respective owners.

The Service contains links to Third-Party Platforms. When you click on a Listing, you leave Nilum's Service and are subject to the terms and privacy policies of the Third-Party Platform. Nilum is not responsible for the content, accuracy, availability, or practices of any Third-Party Platform.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Nilum does not warrant that:

• The Service will be available at all times or free from errors
• The Listings displayed are accurate, complete, or up to date
• The products listed on Third-Party Platforms will meet your expectations

To the fullest extent permitted by applicable law, Nilum disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by Swedish law, Nilum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Nilum's total aggregate liability for any claims arising from or relating to these Terms or the Service shall not exceed one hundred (100) SEK.

Nothing in these Terms shall limit liability for damages caused by intent or gross negligence, or any other liability that cannot be excluded or limited under applicable law.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

The Service uses essential cookies solely to keep you logged in. We do not use analytical or marketing cookies. For more information, please refer to our Privacy Policy.

We may update these Terms from time to time. If we make material changes, we will notify you at least thirty (30) days in advance through the Service or by other appropriate means. If you do not agree with the revised Terms, you may delete your account before the changes take effect. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of those Terms.

We may suspend or terminate your access to the Service at any time for any reason, with reasonable prior notice where practicable. In cases of material breach of these Terms, we may suspend access immediately. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including but not limited to Sections 6, 8, 9, and 14) shall continue in effect.

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of laws principles.

Any dispute arising out of or in connection with these Terms shall be settled by the competent courts of Sweden, with Stockholm District Court (Stockholms tingsrätt) as the court of first instance.

If you are a consumer within the EU, you may also have the right to refer a dispute to the European Commission's Online Dispute Resolution platform or to Allmänna reklamationsnämnden (ARN) at www.arn.se.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nilum regarding the use of the Service and supersede any prior agreements or understandings.
